What are the grounds for divorce?

You can get divorced in Israel if all of the following are true of your situation:

  • You’ve been married for at least a year.
  • Your relationship has permanently broken down.
  • Your marriage is legally recognized in the Israel.

What is the divorce process?

The three main steps of the divorce process are:

  1. Complete and submit a divorce application either as a sole or joint (couple) applicant(s).
  2. Apply for a ‘conditional order’ (previously called a ‘decree nisi’ – an interim order declaring that the divorce can proceed).
  3. Finalise your divorce by applying for ‘final order’ (previously called ‘decree absolute’).
  4. Once the final order has been issued, you’re legally divorced and free to remarry. However, you’ll still need to conclude the financial relationship between you and your ex. The same goes for child arrangements if they’re required, which are also handled separately from the divorce. These two things, if applicable, should be done at the same time as the divorce proceedings.

How long does a divorce take?

The divorce process takes a minimum of 26 weeks to complete. However, most divorces take around 8-12 months to conclude. This is so all your associated financial matters can be resolved before the divorce is finalized.

Can I get full custody of my child?

When we talk about children in family law, custody is no longer a legal definition used. Instead, child arrangements are used to decide how a child lives and spends their time with each parent.
